IMPORTANT — READ BEFORE SIGNING. This is a legally binding release of liability, assumption of risk, and waiver of rights.
In consideration of being permitted to enter the facility of Rogue RC Raceway, located at 1223 Rogue River Hwy, Grants Pass, OR 97527 (the "Club"), and to use its facilities, track, and equipment and to take part in its practices, races, events, and activities (collectively, the "Activities"), the undersigned ("Participant") agrees as follows:
1. Assumption of Risk. Participant understands that radio-controlled vehicle racing and related Activities involve inherent risks, including but not limited to: fast-moving vehicles; collisions; thrown or flying vehicles, parts, and debris; contact with vehicles, barriers, or other people; electrical hazards and lithium-battery (LiPo) charging, overheating, and fire; and trips, slips, and falls — any of which may result in property damage, injury, or death. Participant knowingly and voluntarily assumes all such risks, whether known or unknown.
2. Release and Waiver. Participant releases, waives, and discharges the Club, its directors, officers, members, volunteers, and agents, and the owner of the premises (collectively, the "Released Parties"), from any and all claims, liabilities, demands, or causes of action for any loss, damage, injury, or death arising out of or related to the Activities or the use of the Club's facilities — including claims based on the negligence of the Released Parties — to the fullest extent permitted by law.
3. Indemnification. Participant agrees to indemnify and hold harmless the Released Parties from any claim brought by Participant, on Participant's behalf, or by any guest of Participant, arising out of the Activities.
4. Rules and Safety. Participant agrees to follow all Club rules and safety policies — including those governing track use, battery charging, and conduct — and to follow the directions of Club officers and volunteers.
5. Fitness and Medical. Participant is physically able to take part in the Activities. In an emergency, Participant consents to the Club arranging emergency medical care, and Participant is responsible for the cost of any such care.
6. Media Release. Participant grants the Club permission to use photographs and video taken at Club Activities that may include Participant, for the Club's communications and promotion, without compensation. ☐ Check to opt out.
7. Governing Law; Severability. This Waiver is governed by the laws of the State of Oregon. If any provision is held unenforceable, the remaining provisions remain in full effect.
8. Acknowledgment. Participant has read this Waiver, understands that it is a release of liability and an assumption of risk, and signs it freely.
